Background checks are required for any gun sold by a FFL or that crosses state lines. In state sales between private citizens that reside in the state are governed by state law which varies from state to state. I am inferring from the OP that in MD private sales of handguns require a background check, but private sales of rifles and shotguns do not require a background check.
