I have said much the same thing on DU (based on my own firsthand experience at the US DoS) and been pooh-poohed by those here on DU who staunchly asserted I didn't know what I was talking about - either on the merits or on the law. So far as I know none was either someone who had actually worked at the US DoS or was an attorney. I did and am (or at least was, since technically I am now retired).

Of course, there will likely be attempts to shoot this down on DU by the same numbskull instant legal "experts." But it's nice to see it posted here anyway.
