3. Entrapment is tough to claim in court

To claim entrapment, a defendant must generally prove by a preponderance of the evidence that a law enforcement agent induced them to commit a crime they were not otherwise predisposed to commit. Key requirements include: (1) government inducement involving persuasion, coercion, or extraordinary means, not just opportunity; (2) the defendant's lack of predisposition, meaning they had no prior intent or readiness to commit the crime; and (3) the defendant had the burden of proof to establish these elements.
