2. They're losing the "second phase" so clearly because the first phase was unlike their prior attempts

Compare it to the so-called "first amendment auditors". Their strategy is to get as close to the legal/illegal line as possible to spark a response that they can spin as "tyranny" and abuse (hoping to justify a lawsuit). Sometimes they cross the line and get arrested/charged/convicted (usually because they're legal idiots who misunderstand where the line was in the first place), but it's almost always minor stuff with fewer real consequences than the cash they can bring in from clicks/views on their social media channels because there are enough useful idiots who will continue to believe that the "auditor" was on the side of good.

But just imagine one of them committing serious felonies and yet still trying their "I was engaged in a constitutionally-protected exercise - you're violating my rights!" nonsense? Of course the "second phase" of their plan would fail.
