3. If you defraud Medicare aren't you ineligible?

I worked for an NGO that was paid Medicaid and Medicare funds for services. It was in our yearly trainings that we personally could be ineligible if we defrauded those programs like over billing or billing for services not provided.
Isn't that what his company did when HE WAS CEO?

With what I read about his company's fraud on the system shouldn't he personally be ineligible for Medicare?

Someone should ask him sometime.
And if true shouldn't he recuse himself from all debates, decisions, and discussions and voting on the matter?
