41. Attempted murder is a completely separate charge

And that one is less clear cut. Based on what I've read, he didn't say he knew the Governor was there, just that he knew that the Governor might be there. I don't know if that will make a difference or not - I admit I don't know the specifics of the law. However, I believe if his primary goal was to kill the Governor, he wouldn't have done this at 2:00 AM, but rather chosen a time when he could be sure he would be there. I'm not defending the guy, just pointing out that an attempted murder charge isn't nearly as sure a conviction as arson is.
