MSCS board to possibly file lawsuit over 2026 election alignment

Memphis-Shelby County School (MSCS) board members are set to consider filing a lawsuit over the Shelby County Commission's decision to align the education board's elections in 2026.

The Shelby County Board of Commissioners voted Monday, Sept. 22, to put all Shelby County Board of Education seats up for reelection in 2026.

Education districts 1, 6, 8, and 9 were already up for election in 2026. Districts 2, 3, 4, 5 and 7 — originally up for election in 2028 — will now join the 2026 election cycle, cutting the terms of members holding those seats short by two years.

In a special called meeting on Nov. 18, MSCS board members will discuss possibly retaining outside legal counsel to investigate and start litigation to challenge the commission's vote, alleging that officials abridged the terms of the five MSCS board members elected in 2024.
