If the pictures were in 3D, the nearest "object" would be the Statue, and the moon would be "behind" it.

3. No, the camera is behind the statue, the moon is actually in front of the statue. So the moon is indeed rising

In front of the statue, not behind it.

On edit, if the moon was setting, and the camera was in front, then yes, the moon would be setting behind the statue.
