Do Bad Guys Deserve Due Process?

American residents — who were in the country legally — are now trapped in one of El Salvador’s most brutal maximum-security prisons, a modern-day gulag. This is happening right now.

They were sent by our government without a hearing, without a trial, without being convicted of a crime, for a duration that has not been specified.

-snip-

At its core, due process means the government must follow fair procedures before it can take away your life, liberty, or property. It's not a luxury or a loophole — it's a constitutional guarantee, enshrined in the Fifth and Fourteenth Amendments.

Due process is what keeps America from becoming a country where the government can jail you without telling you why, deport you without a hearing, or take your property without warning. It’s the right to know the charges against you, to have a fair chance to respond, and to be judged by an impartial decision-maker. In criminal cases, it means the government must prove its case — you don’t have to prove your innocence.

It happened in October and she's been "out" on the streets in a homeless shelter with an ankle bracelet for 6 months.

I finally get to testify. And She was definitely guilty, even the police report said they knew she was lying. BUT she still gets "her day in court" ....AND she got to be "free" during this whole time as they had hearings about her mental health etc...

So yeah. While I am looking forward to seeing her locked up...she got due process. And I wouldn't have it any other way. DA's etc are there for a reason, as are defense lawyers. It's a system that has been in place since law was recognized by civilizations as a way to hold society together.
I believe in the Law. I might not like how long it took, and I might even be upset if the Judge doesn't nail her to the wall...but I have to believe that it's a process and part of our Democracy!

They’re not ‘bad guys’ until found guilty in a court of law, consistent with the right to due process.

The problem is that far too many Americans don’t believe that non-citizens are entitled to due process – undocumented immigrants in particular.

And unfortunately, there won’t be much opposition to Trump lawlessly removing immigrants absent due process.

Everyone deserves due process. Without it, neither guilt nor innocence can be established.

Since 1789. It is explicit in the 5th Amendment to the Constutution - in the original Bill of Rights.

It beggars the imagination that every grade school kid is not taught this. Of course I haven't been in grade school for about sixty years...
