Donald Trump’s handpicked U.S. Attorney in Virginia is planning to ask a grand jury in the coming days to indict former FBI Director James Comey for allegedly lying to Congress, despite prosecutors and investigators determining there was insufficient evidence to charge him, sources with direct knowledge of the probe told ABC News.

Earlier this week, prosecutors presented Lindsey Halligan -- Trump’s former personal attorney whom he appointed to lead the United States Attorney’s Office for the Eastern District of Virginia -- with a detailed memo recommending that she decline to bring perjury and obstruction charges against Comey, the sources familiar with the memo said.

A monthslong investigation into Comey by DOJ prosecutors failed to establish probable cause of a crime -- meaning that not only would they be unable to secure a conviction of Comey by proving the claims beyond a reasonable doubt, but that they couldn’t reach a significantly lower standard to secure an indictment, the sources said.

I'm okay with Comey, although I can certainly understand those who despise actions with regard to Hillary. He's not my favorite, but he's not the worst.

Comey IS a very smart man, and I'm sure he's seen this coming and will be ready legally to take on a defense. But can/will it be a fair proceeding? And who will Trump go after next? Obama? Hillary?

This list could include anyone who's ever done any perceived wrong to the orange asshole. He's that childish and (as you indicate) it is taxpayer monies that he couldn't care less that he wastes.

Republicans could stop this, you know. It just amazes me...

How selected?

As I understand it, the grand jury says either YES or NO we find/do not find there is sufficient evidence to charge the person. Does their decision have to be unanimous, or is a majority sufficient?

I note that several grand juries in DC have declined to indict people charged in the wake of Trump's dispatch of his Gestapo into DC.

When this grand jury refuses to indict Comey and several other of Trump's targets, maybe that will be enough for him to die of a stroke.

Justice matters.

47 finally found someone crazy/stupid/unqualified enough (any or all) to actually pursue a prosecution of Comey for supposedly lying to Congress when answered that he had never authorized a leak of information in response to Ted Cruz's 2020 question. It sounds like they are trying to indicate him on lying to Congress on the grounds that he "authorized" McCabe's leak of the status of the investigation into the Clinton Foundation in 2017 -- an accusation already put to rest
