Newly appointed US attorney will attempt to charge James Comey despite prosecutors finding no probable cause: Sources

Donald Trumps handpicked U.S. Attorney in Virginia is planning to ask a grand jury in the coming days to indict former FBI Director James Comey for allegedly lying to Congress, despite prosecutors and investigators determining there was insufficient evidence to charge him, sources with direct knowledge of the probe told ABC News.
Earlier this week, prosecutors presented Lindsey Halligan -- Trumps former personal attorney whom he appointed to lead the United States Attorneys Office for the Eastern District of Virginia -- with a detailed memo recommending that she decline to bring perjury and obstruction charges against Comey, the sources familiar with the memo said.
A monthslong investigation into Comey by DOJ prosecutors failed to establish probable cause of a crime -- meaning that not only would they be unable to secure a conviction of Comey by proving the claims beyond a reasonable doubt, but that they couldnt reach a significantly lower standard to secure an indictment, the sources said.

According to Justice Department guidelines, prosecutors are generally barred from bringing charges unless they can prove a defendant will "more likely than not be found guilty beyond a reasonable doubt by an unbiased trier of fact and that the conviction will be upheld on appeal."

KEY POINTS
* Former FBI Director James Comey is expected to be indicted on criminal charges in the coming days in federal court in Virginia, MSNBC reported.
* The expected indictment comes on the heels of a top prosecutor resigning under pressure after opposing the filing of charges against Comey, who for years has been a target of President Donald Trump's ire.

Author James Comey, former FBI Director, speaks at the Barnes & Noble Upper West Side on May 19, 2025 in New York City. Comey sat with Esposito to discuss his career and new book "FDR DRIVE," the third of a series of fictional crime novels featuring attorney Nora Carleton.

(42,002 posts)Instead of waiting for a formal nomination and Senate confirmation, Ms. Halligan was hastily sworn in as interim U.S. attorney on Monday...
Court records show that Ms. Halligan has never prosecuted any cases and has taken part in only three civil matters in federal court: a failed defamation lawsuit Mr. Trump filed against CNN; an attempt to defend him against a 14th Amendment ballot challenge that was eventually dismissed; and an effort to have the Justice Department freeze its classified documents investigation into Mr. Trump after it conducted a search of Mar-a-Lago...

(16,597 posts)I'm okay with Comey, although I can certainly understand those who despise actions with regard to Hillary. He's not my favorite, but he's not the worst.
Comey IS a very smart man, and I'm sure he's seen this coming and will be ready legally to take on a defense. But can/will it be a fair proceeding? And who will Trump go after next? Obama? Hillary?
This list could include anyone who's ever done any perceived wrong to the orange asshole. He's that childish and (as you indicate) it is taxpayer monies that he couldn't care less that he wastes.
Republicans could stop this, you know. It just amazes me...

Every now and then, a grand jury takes its responsibility seriously.

(3,000 posts)How many members?
How selected?
As I understand it, the grand jury says either YES or NO we find/do not find there is sufficient evidence to charge the person. Does their decision have to be unanimous, or is a majority sufficient?
I note that several grand juries in DC have declined to indict people charged in the wake of Trump's dispatch of his Gestapo into DC.
When this grand jury refuses to indict Comey and several other of Trump's targets, maybe that will be enough for him to die of a stroke.

Hell, Halligan may not even get an indictment. Personally, I would love it if the grand jury told her, and Trump, to fuck all the way off.

(11,888 posts)..would make the laughable attempt prosecute Comey or Letitia James.
47 finally found someone crazy/stupid/unqualified enough (any or all) to actually pursue a prosecution of Comey for supposedly lying to Congress when answered that he had never authorized a leak of information in response to Ted Cruz's 2020 question. It sounds like they are trying to indicate him on lying to Congress on the grounds that he "authorized" McCabe's leak of the status of the investigation into the Clinton Foundation in 2017 -- an accusation already put to rest
AI summary:
Inspector general's conclusion: A later investigation by the DOJ inspector general found that while McCabe had shared information, FBI rules allowed the deputy director to speak with the media without authorization. The report also concluded that former FBI Director James Comey had not authorized the leak.
And of course, she's going after Letiitia James for mortgage fraud.
AI summary on that
Details surrounding the mortgage fraud allegations:
The origin of the referral: In April 2025, William Pulte, Director of the Federal Housing Finance Agency (FHFA), referred allegations to the Justice Department, accusing James of falsifying documents to secure favorable loan terms on properties in Virginia and Brooklyn.
The core claim: Central to the investigation was a 2023 mortgage transaction for a Virginia home James co-borrowed for her niece. A limited power-of-attorney form signed by James mistakenly stated the Virginia property would be her principal residence. This contrasted with her status as New York Attorney General, which requires her to have primary residency in New York.
Contradictory evidence: James's attorney, Abbe Lowell, presented evidence that disproved the claim, including an email James sent to her mortgage broker prior to the closing stating, "this property WILL NOT be my primary residence".
The federal investigation: A five-month investigation by federal prosecutors in the Eastern District of Virginia found no clear evidence that James knowingly made false statements to a financial institution with the intent to defraud.
Continued political pressure:
Resignation of US Attorney: Erik Siebert, the US Attorney in charge of the investigation, was reportedly pressured by Trump officials to indict James despite the lack of evidence. Siebert resigned under pressure in September 2025.
Investigation continues: Following Siebert's resignation, the Department of Justice, under Attorney General Pam Bondi, reportedly appointed a new lead for the investigation and intends to press ahead with the case
