Tylenol maker prepares for glut of lawsuits after Trump's baseless warnings

Source: The Independent

Tuesday 23 September 2025 19:22 EDT

Tylenol maker Kenvue is reportedly preparing for a glut of lawsuits after President Donald Trump made a baseless warning that the active ingredient in the drug, acetaminophen, could cause autism.

At a press conference Monday, Trump repeatedly urged pregnant women, “Don’t take Tylenol.”

Along with Trump’s warning, the Food and Drug Administration issued a notice to doctors of the potential link between Tylenol and autism, and is recommending pregnant women use the lowest dose for the shortest duration possible if deemed medically necessary.

Speaking from the White House, the president told pregnant women to “fight like hell not to take” Tylenol, but if they “can’t tough it out,” to take the lowest dose possible.

This is directly from the Whitehouse.gov page, don't report it as "spreading right wing disinformation"...

"FACT: Evidence suggests acetaminophen use in pregnant women, especially late in pregnancy, may cause long-term neurological effects in their children."

"Large-scale cohort studies — including the Nurses’ Health Study II and the Boston Birth Cohort — report associations between in utero exposure and later diagnoses of autism spectrum disorder (ASD) and attention-deficit/hyperactivity disorder (ADHD)."

"Scientists have proposed biological mechanisms linking prenatal acetaminophen exposure to altered brain development and adverse birth outcomes."

"Andrea Baccarelli, M.D., Ph.D., Dean of the Faculty, Harvard T.H. Chan School of Public Health: 'Colleagues and I recently conducted a rigorous review, funded by a grant from the National Institutes of Health (NIH), of the potential risks of acetaminophen use during pregnancy… We found evidence of an association between exposure to acetaminophen during pregnancy and increased incidence of neurodevelopmental disorders in children.' "

"Harvard University: Using acetaminophen during pregnancy may increase children’s autism and ADHD risk
Johns Hopkins University: Taking Tylenol during pregnancy associated with elevated risks for autism, ADHD."

"Mount Sinai: Mount Sinai Study Supports Evidence That Prenatal Acetaminophen Use May Be Linked to Increased Risk of Autism and ADHD."

"In 2021, an international consensus statement highlighted 'a call for precautionary action,' recommending that pregnant women 'minimize exposure' to acetaminophen 'by using the lowest effective dose for the shortest possible time.' "

32. This will be difficult because of generics

The acetaminophen market is about $10B annually, but about 90% of that is generics, which might be a dozen other suppliers. The patents expired 50-75 years ago. So the first thing a lawyer would have to do is prove that the customer actually took Tylenol and never took a generic.

I am sure there will be a lot of nuisance suits, and some out-of-court playoffs, but I can't see anybody winning anything in court.

A December 2023 ruling found the plaintiffs' experts failed to provide credible evidence linking Tylenol use to autism or ADHD. The case is now being appealed in the Second Circuit. RFK Jr's recently released report will be "pivotal" in establishing that "credible evidence" exists establishing that link.

'Tylenol Autism Lawsuit'

"The court is scheduled to hear oral arguments on October 6 in a series the lawsuits claiming that taking Tylenol during pregnancy may increase the risk of autism in children...These cases are part of the broader Tylenol MDL that has consolidated hundreds of claims alleging that acetaminophen, the active ingredient in Tylenol, can disrupt fetal development when used by expectant mothers...The appellate court’s review is considered pivotal because it will address key scientific and evidentiary issues that will determine whether these claims move forward in federal court or are dismissed."

"The federal government has not yet begun drafting its long-promised autism report, but FDA Commissioner Marty Makary said it will be released within a month...The report is expected, as we talked about on Friday, to explore possible causes of autism...Kenvue stock dropped more than 10% on Friday after reports surfaced that Health and Human Services Secretary Robert F. Kennedy Jr. will soon release a report linking Tylenol use during pregnancy to autism."

Decades a go a breast implant maker was sued because experts said the gel in the breast implants caused disease. That company had to file for bankruptcy. Years later we know no such danger existed. But those jurors believed the experts.

All the data needs to be brought out publicly so they see what a fraud this entire administration is.

The data is there to refute all of this. What these SCUM have done is "cherry picked", and misrepresented data. This is the same garbage these thugs did and are doing with the COVID vaccines.

"A Harvard dean and preeminent epidemiologist whose work was cited by top health officials in the Trump administration as justification for severely curtailing Tylenol use by pregnant women due to a supposed link to autism provided expert testimony in a lawsuit against the drug’s maker that a federal judge called “unreliable.”

Andrea Baccarelli, dean of the Harvard T.H. Chan School of Public Health, submitted written testimony in 2023 that his review of the scientific literature led him to conclude that prenatal exposure to acetaminophen, the active ingredient in Tylenol, “can cause the offspring to develop” neurodevelopmental disorders such as autism and ADHD. A Harvard spokesperson said that Baccarelli was paid roughly $150,000 for his work on the case.

The federal court judge excoriated Baccarelli’s testimony, writing that “Dr. Baccarelli downplays those studies that undercut his causation thesis and emphasizes those that align with his thesis.”

U.S. District Judge Denise Cote of the Southern District of New York noted that neither Baccarelli nor four other experts paid to testify for the plaintiffs “has published research that expresses the ultimate opinions they offer here. Indeed, the plaintiffs’ lead expert on causation, Dr. Baccarelli, as recently as 2022, co-authored a study on the prenatal effects of acetaminophen that cautioned against any change in clinical practice.”

Here is push back against rfk jr and the anti-vaxers on their outrageous claims about the COVID vaccine.

""What these people do, is that they search, they find one paper or two papers that make an outlandish claim based on bad data that hundreds or thousands or tens of thousands of other papers refute, they don’t mention everything that refutes it. They only mention, oh, look, I found a paper that says spike is around for nine months! It’s just not true."

And that can be bad for a pregnant woman and a developing fetus. Uncontrolled pain isn’t good either, and I ‘toughed out’ a difficult childbirth with almost no pain med, so lecturing women on putting up with pain is ignorant.
