Peter Strzok, the FBI agent who sent anti-Trump texts, loses First Amendment case over his firing

Former FBI agent Peter Strzok has lost a long-running lawsuit claiming he was illegally fired during Donald Trumps first term after sending text messages that criticized Trump.
Strzok argued in the lawsuit that his FBI bosses had retaliated against him in order to placate Trump, who was outraged over texts that Strzok exchanged while investigating ties between the 2016 Trump campaign and Russia.
In a ruling Tuesday, U.S. District Judge Amy Berman Jackson said that, after several years gathering evidence and testimony from those involved in the 2018 decision to terminate the veteran counterintelligence agent, Strzoks lawyers had failed to show that his dismissal violated his First Amendment rights.
Jackson, an Obama appointee, stressed that she was not ruling on whether Strzoks firing was the appropriate sanction for his conduct, only that the voluminous evidence assembled over years of litigation including a deposition of Trump himself had not proven Strzoks rights were violated.

(28,447 posts)If the firing violated his 1A rights, we can assume that the Biden DOJ would have settled that case too years ago (and/or an Obama judge would not have ruled against him).

(68,150 posts)Everybody in LE knows they can be fired for things they say on social media. Texts are not a good idea too because of FOI laws that make them readily available.
I was a state employee for many years. I knew I couldn't say anything political on social media or publicly. I would have been fired.
What's infuriating is that MAGA ignores these rules and say outrageous things all the time. The rules don't apply to them apparently.

In a notice filed with two federal judges in Washington on Tuesday, the Justice Department said it had reached settlements of legal claims that fired FBI agent Peter Strzok and former FBI attorney Lisa Page brought in 2019 alleging that the disclosure violated their privacy.
The terms of the settlements were not disclosed in the notice, which said Strzoks claims that his firing violated his First Amendment and due process rights are not resolved by the agreement. That litigation, alleging that the FBI caved to political pressure from Trump to fire Strzok just before he was eligible for full retirement pay, is ongoing.
Until now, the Justice Department has denied liability and fought the claims in both suits. Efforts to resolve the cases through mediation have been underway for at least six months.
