Two Republican lawmakers have introduced legislation seeking to ban the enforcement of Sharia law in the United States, arguing the measure is necessary to preserve constitutional principles and American culture.
The proposal, called the "No Shari'a Act," was announced this week by Florida Representative Randy Fine and Texas Representative Keith Self. Newsweek contacted Fine via an online form, and Fine and Self by telephone outside of usual working hours on Sunday.
Why It Matters
The bill reignites long-standing debates over the role of foreign or religious legal systems in U.S. courts, particularly regarding Islamic law. Supporters say it would protect the Constitution from being undermined, while critics warn it could fuel Islamophobia and face constitutional challenges of its own.
What To Know
The legislation would bar courts from enforcing any judgment, decree, or arbitration decision based on Sharia law or any foreign system that violates constitutional rights. Its sponsors argue that America must remain unified under one legal frameworkthe Constitutionand reject attempts to introduce alternative systems.

These idiots aren't even following or upholding the CURRENT "legal framework - the Constitution'. I.e., they have completely abdicated their authority as a co-equal Branch of government.

(26,519 posts)has ever been passed in this country, and 2) a contract based on sharia law, or any other religious, philosophical, political, or economic theory, is still a valid contract if both parties agree to it.

(2,849 posts)It is absolutely lawful to make contracts unenforceable if they contain certain provisions. There are hundreds of such examples on the books.
We should be doing everything we can to push back agains Sharia law (and any other religious-based laws).
Martin68
(26,519 posts)is only unenforceable if it requires one party to engage in illegal acts, forfeit any of their legal rights, or act in any way that may pose harm to society in general. A contract may be based on tenets of sharia law as long as that is not the case. The same restriction applies to any contract that is based on a belief of any kind, whether not is based on religion, philosophy, or what have you.

Just because the Rethugs are grandstanding on this issue and are generally clueless, we can all agree Sharia law is not something we want to defend, ever.

(645 posts)It seems like the courts are the only ones currently in the government that are trying to obey the constituion. Hey if you want to pass a stupid law that does absolutely nothing except scare people that Muslim's are going to take over go for it, you're just wasting time, paper and money.
