Immigration judge orders Mahmoud Khalil to be deported to Algeria or Syria

"An immigration judge has ordered Mahmoud Khalil be deported to Algeria or Syria, alleging he omitted information from his green card application, according to court documents filed Wednesday."

"Immigration Judge Jamee Comans, based out of Jena, Louisiana, on Friday denied Khalil's motion for a waiver preventing his removal from the United States because of alleged misrepresentations made in an application for an adjustment of status."

"She doubled down on that ruling, saying the court found Khalil’s “lack of candor on his I-485 form was not an oversight by an uninformed, uneducated applicant.” The form is an application to register permanent residence or adjust status."

“Rather, this Court finds that Respondent willfully misrepresented material fact(s) for the sole purpose of circumventing the immigration process and reducing the likelihood his applications could be denied. This Court cannot and will not condone such an action by granting a discretionary waiver,” Comans said."

As most here probably know, Immigration judges are not life-tenured Article III Judges within the US Judiciary. They are Article II Executive Branch employees.

Because If the government looked closely enough at EVERY green card application, some pertinent information would likely be omitted.

What they should do is review Melania Trump's former green card application, but of course they won't.

NBC News reviewed more than 100 pages of documents the federal government submitted in its effort to deport Khalil, along with evidence filed by his legal team — including his permanent residency application, articles about his activism and contracts and letters outlining his internship and work experience.

In some cases, the government appeared to rely on unverified tabloid reports about Khalil. In others, its claims were factually incorrect because of inconsistent timelines and mischaracterizations of his work history.

they go along to get what they want. So will Article III Federal Judges and Justices, who, after Senate Confirmation, are appointed to the Judicial Branch with life tenure.

The distinction is that officials from the Executive and Judicial Branches often do not want the same thing. While Article III Judges and Justices wish to be seen as non-political/non-partisan, they still were nominated by a partisan POTUS and confirmed by partisan Senators, who believed nominees' "judicial philosophies" guaranteed judgments aligned with partisan priorities.

The Article II Executive Branch Senior Officials, from POTUS to the GS-9 Schedule C appointee, are inherently, openly, and unashamedly partisan, as are all Article I elected members and their Congressional staffs.

The Trump administration has accused Khalil, a green card holder, of withholding information about his membership in certain organizations, including that he was a political officer of the United Nations Relief and Works Agency of Palestine Refugees and that he was part of Columbia University Apartheid Divest. Furthermore, the Trump administration said he failed to disclose his previous employment at the Syria Office in the British Embassy in Beirut in his permanent residency application last year.

The Trump administration had accused Khalil of withholding information that he was a “political affairs officer” for the United Nations Relief and Works Agency of Palestine Refugees, but he was an unpaid intern at the agency for six months in 2023. No such position exists at the agency.

Homeland Security officials also accused Khalil of failing to disclose his “continuing employment” with the Syria office in the British Embassy in Beirut “beyond 2022.”

His lawyers argue that he ended his contract at the British Embassy in Beirut in December 2022 so that he could attend Columbia.

Officials also accused Khalil of failing to disclose that he is a “member” of Columbia University Apartheid Divest. Evidence submitted by the government includes news articles from April 2024, though his application was submitted weeks earlier.

I believe he is a citizen of both countries.

ETA: Oh, she's the one from Louisiana.......She's bad...I believe I read an expose about her years ago.
