GREENBELT, Md. (AP) -- The U.S. government would initiate deportation proceedings against Kilmar Abrego Garcia if he's released from jail before he stands trial on human smuggling charges in Tennessee, a Justice Department attorney told a federal judge in Maryland on Monday.
The disclosure by U.S. lawyer Jonathan Guynn contradicts statements by spokespeople for the Justice Department and the White House, who said last month that Abrego Garcia would stand trial and possibly spend time in an American prison before the government moves to deport him.
Guynn made the revelation during a federal court hearing in Maryland, where Abrego Garcia's American wife is suing the Trump administration over his mistaken deportation in March and trying to prevent him from being expelled again. ... Guynn said U.S. Immigrations and Customs Enforcement would detain Abrego Garcia once he's released from jail and send him to a "third country" that isn't his native El Salvador. However, Guynn said he didn't know which country that would be.
U.S. District Judge Paula Xinis said trying to determine what will happen to Abrego Garcia has been "like trying to nail Jello to a wall." She scheduled a hearing for Thursday for U.S. officials to explain possible next steps if Abrego Garcia is released.

Check over in GD for more about this, because DUer In It to Win It posts extensively there about the many trials involving deportation. He adds a legal perspective that I cannot.
He's doing terrific work.

(6,192 posts)I have a feeling this could be the flash point. There's been too much done to him, and too many people who are knowledgeable about the circumstances, the man, and the maladministration's dirty tricks towards him. There no doubt are others just as possible because of who they are and their circumstances, but the press made a mistake and broadcast his name and situation enough that all you need to do is say his name to get a knowing response from people. That makes a flashpoint. I, for one, am hoping for it. We need something to break this government's "laws for thee, not for me, but don't ask me to explain the laws or the why." We need to get a hell of a lot of people riled up, real fast. Fast enough that we take this rule-breaking "govt" by surprise with our fervor and determination. It seems obvious from other posts here that the PTB on our side feel like we're asking too much of them. I guess we have to show the majority of them how and why it's done.

Sounds like the government has already convicted him. You'd think he was Che Guevara, Spartacus, Nat Turner and Sitting Bull all rolled into one the way they are trying to railroad him out of the country. And you know if they thought they could get away with it execute him.
