Judge to hear arguments over transfer of Abrego Garcia to Maryland from Tennessee

The federal judge overseeing Kilmar Abrego Garcia's deportation case in Maryland will hear arguments Monday over whether Abrego Garcia should be transferred to Maryland as he awaits trial on human smuggling charges in Tennessee.
Abrego Garcia's attorneys filed an emergency motion last week seeking to have him returned to Maryland should he released on bond, but government attorneys say they will seek to deport him to a country other than his native El Salvador, where he is prohibited from being sent due to a 2019 court order.

U.S. District Judge Paula Xinis, who has been handling Abrego Garcia's Maryland case, will also hear arguments from the Trump administration seeking to have Abrego Garcia's Maryland case dismissed.
Abrego Garcia, who was deported in March to El Salvador's CECOT mega-prison despite a 2019 court order barring his deportation to that country due to fear of persecution, was brought back to the U.S. last month to face charges in Tennessee of allegedly transporting undocumented migrants within the U.S. while he was living in Maryland. He has pleaded not guilty.

Trump administration says it will deport Kilmar Abrego Garcia before his trial if hes released from criminal custody

(CNN) The Trump administration will take steps to deport Kilmar Abrego Garcia before he goes to trial in Tennessee if hes released from criminal custody, which could happen as soon as next week, a Justice Department attorney said Monday.
The comments came during a wide-ranging court hearing in Maryland during which US District Judge Paula Xinis tried to pin down what the administrations plans are for Abrego Garcia, who was recently returned to the US to face charges of human smuggling after being wrongly deported to El Salvador in mid-March.
You would not wait for the criminal case? Xinis asked DOJ attorney Jonathan Guynn at one point. The Department of Homeland Security is removing people from this country very fast
are you going to take the same speed with Mr. Abrego?
Theres no intention to just put him in limbo in ICE custody while we wait for the criminal case to unfold, Guynn replied. He will be removed, as would any other illegal alien in that process.

(20,387 posts)THIS judge to order Garcia brought to his court room by a dozen or so sworn in (by him) US Marshals? I honestly do not know what he could do. What are his limits?
