Trump asks Supreme Court to allow him to end birthright citizenship

CNN — President Donald Trump’s administration asked the Supreme Court in a series of emergency appeals Thursday to allow him to move forward with plans to end birthright citizenship, elevating a fringe legal theory that several lower courts have resoundingly rejected.

In a series of emergency appeals, the Trump administration argued that lower courts had gone too far in handing down nationwide injunctions blocking the controversial policy, and it asked the justices to limit the impact of those orders.

Appeals courts have brushed aside the Trump administration’s request to pause lower court rulings that imposed nationwide injunctions on an executive order he signed on the first day of his second term.

“Universal injunctions have reached epidemic proportions since the start of the current administration,” the Justice Department told the Supreme Court in its emergency appeals. “Those universal injunctions prohibit a Day 1 Executive Order from being enforced anywhere in the country, as to ‘hundreds of thousands’ of unspecified individuals who are ‘not before the court nor identified by the court.’”

kiss the Constitution goodbye. They will have ruled that the President has superiority over the Constitution itself (Amendment 14 to be specific. We will no longer have a Constitution that means a damn in the face of a Presidential preference for it saying or meaning something else. Article 14 is pretty clear.

He is trying outlandish actions just to show that he can do them. When he has pushed enough laws far enough no one will be able to stand against him on anything. It is part of the "unitary executive" plan.

The SCOTUS 6 would perhaps rule that there’s nothing in the constitution that explicitly says he can’t do that. Except for that pesky oath of office thing… just words, pffft.

appropriate legislation, the provisions of this article."

That means for Congress to define, "...and subject to the jurisdiction thereof," enacting legislation would need to be passed by the House of Representatives (218 votes when there are 435 Representatives) and the Senate (60 votes to invoke cloture when there are 100 Senators). The final tally would be 279, broken down into 218 Representatives, 60 Senators, and one President.

Regardless of whether the legislation was wise or moronic, any SCOTUS - not just the nine that sit today, would - would likely uphold it unless it violated a different Constitutional provision.

He’s hoping the 6 Nazgûls on SCOTUS will help him accomplish this. He hasn’t kept any of his other promises to his rabid base, so he’s got to up his numbers on this, Constitution is once again, just toilet paper for his giant orange ass. This is the same reason he is now going after legal immigrants like the Columbia student protester he just disappeared, he can’t do any of this stuff by following the law, he’s going to take it to the same bought and paid for jerks in robes that made him above the law in the immunity ruling. What he wants to end is the Constitution of the United States. Giving him what he wants on this issue is a license to get rid of anything else he doesn't like.

And right now, with all the people rising up against him and his buddy Elon, the thing he needs to get rid of most is the Sixth Amendment. He would LOVE to throw people in jail for no reason and hold them indefinitely without charges.
