Maybe skipping the VA court of appeals? Going to end up in their Supreme Court anyway so why not cut to the chase. Looking at their Supreme Court make up, maybe 4 of the 7 lean our way? Unsure since they're appointed by VA governors or their legislature.

Marc Elias is referring to the third case listed in the article, with RNC as the plaintiff and VSBE as defendant. The judge is at the circuit ct level and issued his decision AFTER the linked Pilot article came out.

At least the first case (and maybe the others) will be heard at the VA Supreme Ct at 9 am tomorrow.

This is a ruling by the circuit court in Richmond. There were several cases filed against the redistricting amendment after the voters approved it. I don’t know if the Richmond court overturned the Tazewell judge or if this is a ruling in a different case. The Virginia Supreme Court will hear arguments tomorrow. Their decision *should* be the final word.

Unfortunately, even if we win, we can’t really let down our guard. It’s inevitable, even when you think it’s over and you’ve won, there’s gonna be SOMEBODY coming along to object, maybe well-funded (and enjoying the hell outta that),
- or they’re driven by true passion, even though they can’t pull themselves up out of the 13th century,
- or maybe there’s a few broken souls who hate knowing others are having a nice mellow time, and they just HAVE TO stop it (whether they themselves were invited or not). As Art Linkletter used to say (while cashing in on TV), “People are Funny!”

There are currently three challenges to the April 21 referendum that voted YES to redistrict Virginia into 10-D and 1-R.

1. A Tazewell County judge ruled the referendum was invalid. This is the same judge from a small, rural SW VA county who ruled the referendum could not go on. He was overturned then. I'M NOT CERTAIN WHERE THIS STANDS BUT IT WILL BE OVERTURNED WITHIN A DAY OR TWO.

2. The RNC sued to overturn the referendum. THIS IS THE ONE TO WHICH MARC ELIAS REFERS -- IT WAS OVERTURNED BY A RICHMOND CIRCUIT COURT JUDGE.

3. Some Republicans in the Virginia General Assembly sued to overturn the referendum. THIS ONE WILL BE HEARD BY THE VA SUPREME COURT TOMORROW, MONDAY, APRIL 27.

Republican National Committee v. Koski Tazewell County Circuit Court Injunction

RICHMOND, Va. – Attorney General Jay Jones today made the following statement on the injunction issued by the Tazewell County Circuit Court in Republican National Committee v. Koski.

“My office will immediately file an appeal in the Court of Appeals. As I said last night, Virginia voters have spoken, and an activist judge should not have veto power over the People’s vote. We look forward to defending the outcome of last night's election in court.”

What this means is the RNC has filed suit in two venues: Richmond and Tazewell County.

The Richmond Circuit Court ruled against the RNC and that case is dead -- the referendum is safe from that suit.

In Tazewell County, the RNC is suing STEVEN KOSKI, in his official capacity as Commissioner of the Virginia Department of Elections, claiming that the referendum is illegal. VA Atty Gen Jay Jones is defending Steve Koski because of Koski's official position as Commissioner of Elections. The case will be heard in Richmond, possibly in the same court that threw out the RNC case earlier.

I reside in Texas and sadly, with our lousy state government, we did not get the chance. We have one of the Felon's main cronies as Governor, Greg Abbott. When the Felon tells Abbott to jump, he responds, "How high?"
