Let's take a walk! This afternoon — Sunday, April 19 — we're talking a recent New York Times investigation into the creation of the shadow docket, and what it says about John Roberts' self-mythology as a judicial umpire.

...and I've said many times that the Trump ruling is going to go down in history having the same infamy as decisions like Dred Scott, Plessy, and Korematsu. The very thorough decision of the D.C. Court of Appeals was thrown into the crapper in favor of yet another convoluted Roberts decision that places a series of tests to determine what's legal, contravening one of the Court's oft-stated missions to "simplify" the law. This Court did the same thing in the Colorado decision, wrenching the state's right to govern qualifications for elections and throwing in a test that essentially invalidates any way to apply the disqualification clause to insurrectionists.

In a horrible mix of metaphors, Roberts seeks to have a finger in every pie while keeping his thumb on the scale.

The leaks are indicative of a Court that is not just fractured, but now has members visibly, audibly, and, in writing, showing contempt for one another. That's a huge failure in leadership, and the Chief Justice's two-faces doesn't help.
