WASHINGTON (AP) President Donald Trump s administration is asking the Supreme Court to uphold his birthright citizenship order declaring that children born to parents who are in the United States illegally or temporarily are not American citizens.
The appeal, shared with The Associated Press on Saturday, sets in motion a process at the high court that could lead to a definitive ruling from the justices by early summer on whether the citizenship restrictions are constitutional.
Lower-court judges have so far blocked them from taking effect anywhere. The Republican administration is not asking the court to let the restrictions take effect before it rules.

(60,565 posts)However, if it did apply to people born in the past, it would totally anger Trump if he, Melania and Barron had to supply DNA to prove he was the biological father.
I wonder, if legally, Trump's EO reaffirms the citizenship of all people born in the US by being written that way. It is still unconstitutional.
looks like his father, so dont think thats an issue.

There is probably an argument to be made over the legal status that Melania carried at the time.
There is NOT however any such gray area with Barron - who carries full citizenship through both parent, and birthright.
This might serve up as amusement for some people - but there is no factual or legal element involved - (at least with the president's son)

I dont think both meant both parents.
Both refers to birthright & parent. Meaning he is a citizen due to being born in the US (birthright) and via having a US citizen parent (his father). Either or both of those qualifies him as a US citizen.
