From the EEOC:

Harassment becomes unlawful where 1) enduring the offensive conduct becomes a condition of continued employment, or 2) the conduct is severe or pervasive enough to create a work environment that a reasonable person would consider intimidating, hostile, or abusive.

Petty slights, annoyances, and isolated incidents (unless extremely serious) will not rise to the level of illegality. To be unlawful, the conduct must create a work environment that would be intimidating, hostile, or offensive to reasonable people.

Having worked for decades in a corporate environment, I know that when there is a complaint, the lawyers who investigate are looking to establish a pattern.
By definition, one off-handed remark, even if inappropriate, can't firm a pattern.
Now, there may be more to this particular story, but we can't know it from this write-up.
We had to make several cultural shifts as we became more international because we ran our foreign plants under the same rules as our American sites. (Which is the law for American corporations, but woefully few companies actually do it.)
Brazil was a particular issue for us. I couldn't send my female reports there, because nobody would listen to them & make the recommended changes.
Then, I'd have to go down there to make them do what my staff members said. That's a waste of effort & embarrassing for my subordinates. So, I would just make changes there myself.
5 years later, the site manager was a woman. So, we did change attitudes.

This took place in a all male shipboard environment.
We would break each others balls all the time. No offense was given nor taken.
But when in my employment with the state of WA, such comments were too risky.
