While Judge Kaplan indicated that the Trump's conduct met the common understanding of rape, as a legal matter, the jury only found Trump liable for sexual abuse and sexual battery and expressly conceded that Carroll had not proven that Trump raped her as that term was defined in applicable NY law at the time of the assault. AOC didn't say he was found liable for rape or described him as an adjudicated rapist, so her statement would be much more difficult for Trump to use as the basis for a defamation claim.
